Article 1: Objects of the general conditions of sale
These general terms and conditions of sale are intended to govern the contractual relations between the Company and any person purchasing

Any purchase made on the website www.lejardindemademoiselle.com implies acceptance of these general conditions, which the Customer acknowledges having read, understood and accepted with full knowledge of the facts. He also acknowledges having had the opportunity to download and print them. The Customer declares to be of legal age and capable of entering into a contract.

Le Jardin de Mademoiselle reserves the right to adapt or modify its general terms and conditions of sale at any time. In the event of a modification, Le Jardin de Mademoiselle will apply to each transaction the general terms and conditions of sale in force on the day of the transaction.

Article 3: Our services
The Company offers on its website lejardindemademoiselle.com different sections offering teas, infusions, accessories (dishes, household linen, filters, etc.) and virtual events (Masterclass and special Tea Time).
The website managed by the Company is, in principle, accessible 24/7, except for interruptions, scheduled or not, for maintenance purposes or in the event of force majeure. Being in fact
subject to an obligation of means, the Company cannot be held responsible for any damage, whatever its nature, resulting from unavailability of the site. In the event of a problem, the Company undertakes to do everything possible to restore access to the site as quickly as possible. The interruption of this access cannot give rise to any compensation.
The “boutique” products offered (excluding dematerialized offers) may be shipped to mainland France, Belgium, Luxembourg and Switzerland with shipping costs corresponding to the current La Poste rates or any other carrier. On request, the Company may provide a quote for shipping outside this geographical area.

Article 4: Ordering terms
The Customer has the possibility to order on lejardindemademoiselle.com via the secure services SHOPIFY PAYMENTS or PAYPAL for the payment method. The Customer guarantees that he is fully authorized to use the bank card and that this bank card gives access to sufficient funds to cover all costs resulting from purchases on www.lejardindemademoiselle.com.
By clicking on the order completion button during the order process, the Customer declares to fully and unreservedly accept all of these General Terms and Conditions of Sale. The Customer will pay for his order in euros via the secure SHOPIFY PAYMENTS or PAYPAL services. The Company therefore does not hold the bank details of its customers under any circumstances.

Article 5: Conclusion of a contract between the Client and the Company
In order to benefit from the services provided by the Company, the Customer must first create a personal customer account on the website www.lejardindemademoiselle.com. If the information disclosed by the Customer is erroneous or inaccurate, the Company cannot be held responsible and will not compensate for any resulting damages.
With regard to the Shop, the contract is formed once the Customer has validated his order and made payment for it.

Article 6: Sale price and payment terms
All product prices are indicated in euros, all taxes included. The Company reserves the right to modify its prices at any time without notice. Products and any costs will be invoiced on the basis of the rates in effect at the time the order is registered.
The items belong to the Company until the transaction amount has been fully collected. The price is payable in full and in a single payment. The price is due immediately on the date of the order.
The Customer may pay by credit card via the secure SHOPIFY PAYMENTS or PAYPAL services. The Company shall not be held liable for any fraudulent use of a credit card. These services allow the Customer to pay online without communicating their financial information to the Company during the transaction.
It is the Customer's responsibility to save and print their payment certificate if they wish to keep the banking details relating to their transaction.

Article 7: Verification of payments
In order to secure payments on its site, the Company reserves the right to verify information relating to the customer to ensure that the person whose bank account is debited is indeed the one who placed the order.
For this verification, the customer may be asked for proof of identity and/or address and/or banking documents (RIB or cancelled check). In the absence of a response from the customer to this verification within 2 days of this request, the order in question will then be cancelled without the possibility of a subsequent claim.
After verification, the Company reserves the right to freely cancel any order presenting a risk of fraudulent use of a bank card.

Article 8a: Deadlines, shipping and delivery
Mademoiselle's Garden delivers exclusively in France
metropolitan France, Belgium, Luxembourg and Switzerland with shipping costs corresponding to the rates of La Poste in force or any other carrier. On request, the Company may draw up a quote for shipping outside this geographical area.
Deliveries are made via Colissimo (La Poste) in Relais Pickup or at home against signature. A tracking number is sent to the customer from the sending of the package. The customer's order is shipped within
subject to available stock. The shipping time for an order is between 1 week and 15 days in the case of a seasonal sale.
Unless otherwise provided, delivery is made to the address indicated by the Customer when ordering via the website www.lejardindemademoiselle.com.
Once the order has been validated, the Customer will not be able to modify their delivery address. The Company cannot be held responsible for an error in the postal address.
The package remains the responsibility of the Company's carrier until it is delivered to the Customer. In the event of non-receipt of the package, the Customer must first file a complaint with our carrier and write a sworn statement of non-receipt. After the investigation period and depending on the conclusions, the Company will proceed or not to reimburse the order.

Article 8b: Preparation of orders
The packages are prepared by an ESAT, a partner of the Company. In the event of seasonal pre-sales, the deadlines may be exceptionally extended.

Article 9: Right of withdrawal/return
The Customer has 14 working days from receipt of the product to exercise his right of withdrawal, without having to provide a reason, and without penalties (articles L 121-16 A L121-20-10 of the Consumer Code). After this period, the products will not be returned or exchanged.
In the event of withdrawal, the product will be refunded by gift card to be used on a future order.
In the event of withdrawal, the products must be returned intact in their original packaging, without any trace of use and accompanied by the original invoice. The Company reserves the right not to reimburse the Customer if the items are returned incomplete, damaged, damaged or soiled. The return delivery costs are always the responsibility of the Customer.
In the event of non-receipt of the item returned to the Company by the Customer due to theft, loss, breakage during transport or any other cause preventing Le Jardin de Mademoiselle from properly receiving the returned item(s), the Company will cancel the refund process and the Customer will not be refunded.
Any item purchased on www.lejardindemademoiselle.com cannot be returned for exchange or refund except in the case of withdrawal. In the event of a return, contact customer service.

Article 10: Warranty/conformity/responsibility
The Customer is solely responsible for the choice and use of his products, which he will make his personal business. The Company cannot be held responsible for any damage or loss of quality due to the use of products purchased on the site. Its liability cannot in any case be sought beyond the price of the product purchased.
The composition of each product is written in French on the back of all products offered for sale on the site, as well as its conditions of use. The Company is in no way responsible for the misuse of the products.
The Company will be responsible for its legal warranty obligation, in particular with regard to hidden defects. It undertakes to provide the customer with all technical and commercial information at the latter's written request.
The Company has, for all stages of access to the site, the ordering process, delivery, customer service, or subsequent services, only an obligation of means. The liability of the company Le Jardin de Mademoiselle cannot be engaged for all the inconveniences or damages inherent to the use of the internet network, in particular a breakdown of the service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with the case law.

In accordance with Article 34 of the French law of 6 January 1978 relating to information technology, files and freedoms, the Client has a right to access, modify, rectify and delete personal data concerning him/her. This right may be exercised by contacting the Company's customer service.
The information provided by the Client is strictly confidential and for the exclusive use of the Company, which undertakes not to distribute customer data to third parties.

Article 12: Deactivation of the customer account
Failure to comply with these General Conditions of Sale, any payment incident, provision of false information or actions contrary to the interests of the company will result in the temporary or permanent suspension of the customer account.

Article 13: Amicable resolution of disputes
Any complaints must be addressed to the Company's customer service. A response will be provided within 72 hours (Monday to Friday only, excluding Saturday and Sunday).
